    Fee Schedule, Retainer Terms, and Testimony Policies

  • Private Practice Rate – $325/hour
  • PRE Rate – $325/hour
  • PRE Retainer is $9,425, which covers the first 29 hours of work on the case. Once the retainer is exhausted, additional charges will be billed at the same hourly rate of $325 and invoiced prior to the submission of the PRE report. All payments must be settled in full before the report is submitted.
  • PRE work will not commence until the retainer is paid in full.
  • Once a PRE is court-ordered, your evaluation time is reserved exclusively for your case. If full payment of the retainer is delayed, a $250 weekly holding fee will apply until payment is received. This ensures your reserved slot remains on the schedule and covers the administrative time required to maintain case readiness.

Testimony and Deposition Policy:

  • If subpoenaed to testify at the final hearing, a non-refundable fee of $5,200 will be charged to cover the PRE’s reassessment of the complete file, preparation for testimony, and the time commitment required for the trial date. This fee applies regardless of whether the hearing proceeds as scheduled. This policy is in place because, by this point in the timeline, the schedule has already been reserved for case preparation and the trial date, preventing availability for work with other families and their case management.
  • Depositions, if permitted under the applicable PRE statute, will be billed at $325 per hour, with a non-refundable retainer of $2,925 (six hours) due in advance. Final charges will be determined based on the specifics of the case and the deposition schedule. The retainer applies regardless of whether the deposition proceeds as scheduled, and a minimum of two weeks’ notice is required.

Remote/Virtual Testimony and Deposition Requirement:

  • All PRE services, including interviews, evaluations, testimony, and depositions, are conducted exclusively through secure remote/virtual platforms. This requirement is a condition of engagement and applies regardless of any court orders or stipulations that may be sought by the parties after retention. By engaging services, all parties and counsel agree that no in-person testimony or deposition will be provided under any circumstances. Any attempt to modify this arrangement will be considered a breach of contract, and all documented time spent addressing such a breach with the court will be billed at $600 per hour.
